EB-5 Investor Visa, also referred to as EB-5 Entrepreneur Visa

Under the EB-5 Category you can qualify for U.S. Permanent Residence (Green Card) by investing a minimum of $1,000,000 USD in a U.S. based business that employs at least 10 full time American workers. If the business is located in a rural area or an area with high unemployment the amount of the minimum investment is reduced to $500,000 USD.

Conditional lawful permanent residence (Green Card) is granted by United States Immigration and Citizenship Service (USCIS) if and  when you actually make the requisite investment by actually spending it on starting your own business or investing it in a limited partnership or other entity.

Your spouse and children under 21 years of age can join you and be issued conditional Green Cards. The initial Green Card is conditional because after holding it for two years you must file an application with USCIS to remove the condition. This is accomplished by showing that your investment actually served to create or preserve at least 10 full time jobs for American workers.

When you are issued an unconditional Green Card you are free to sell the qualifying investment while maintaining your status as a Permanent Resident.

You can be a passive investor, for example: If you buy a McDonald’s franchise and arrange for management. If the business holds its own or produces a reasonable profit, after two years with an unconditional Green Card in hand, you may decide to sell the business and get back what you originally invested or realize a profit.
